TERMS AND CONDITIONS

These Terms and Conditions ("Agreement") govern the rental of motorcycles and all-terrain vehicles (ATVs) ("Vehicles") from Viva Motors, located in Santorini, Greece ("Company", "we", "us", or "our"). By renting a Vehicle from us, you ("Renter", "you", or "your") agree to be bound by this Agreement.

• You must be at least 21 years old to rent an ATV and at least 18 years old to rent a scooter or motorbike up to 125cc.
• You must hold a valid driver’s license:
  
  • EU citizens: A valid EU license is accepted.
  • Non-EU citizens: An International Driving Permit (IDP) is required, in addition to your national license.
• A valid passport or national ID card must also be presented at the time of rental.

• Rental charges are calculated per day, based on the agreed duration.
• Late returns beyond the agreed rental period will incur additional fees.
• Vehicles must be returned clean, with the same fuel level, and in original condition, unless otherwise agreed.
• We reserve the right to refuse rental if a customer appears unfit to operate a Vehicle safely.

• Full payment is required at the start of the rental period.
• A refundable security deposit is required. This may be paid in cash or held on a credit card.
• The deposit will be returned after the Vehicle is inspected and returned without damage.

By renting from Viva Motors, you agree to:

• Drive only on paved and authorized roads. Off-road use, including beaches and rough terrain, is strictly prohibited.
• Not operate the Vehicle under the influence of alcohol or drugs.
• Use helmets and appropriate safety gear (provided upon request or included).
• Not allow unauthorized persons to drive the Vehicle.
• Not participate in races, stunts, or reckless driving.
• Comply with all Greek traffic laws, including speed limits and road signage.

• Basic third-party liability insurance is included as required by Greek law.
• The Renter is responsible for:
  
  • Any damage to the rented Vehicle not covered by insurance.
  • All traffic fines or legal violations during the rental period.
• Optional full insurance or collision damage waiver (CDW) may be available for an additional fee.
• Viva Motors is not liable for personal injury, loss of property, or accidents occurring during the rental period unless due to negligence on our part.

• In case of accident, theft, or breakdown, the Renter must contact Viva Motors immediately.
• The Renter must not leave the scene of an accident until proper authorities and the Company are informed.
• Any unauthorized repairs are not reimbursed.

• Free cancellation up to 24 hours before the rental period.
• Cancellations within 24 hours or no-shows may result in full or partial forfeiture of the rental fee.
• In case of adverse weather (heavy rain, strong winds), rentals may be rescheduled or refunded at our discretion.

• Vehicles are rented with a specific fuel level and must be returned with the same level.
• Fuel is not included in the rental price.

The Renter agrees to indemnify and hold harmless Viva Motors and its employees or agents from and against all claims, demands, liabilities, damages, or expenses (including legal fees) arising out of or in connection with the use of the rented Vehicle.

This Agreement shall be governed by the laws of the Hellenic Republic (Greece). Any disputes arising under this Agreement will be handled in the courts located in Thira (Santorini), Greece.

By signing the rental agreement or using Viva Motors’ services, you confirm that you have read, understood, and agreed to these Terms and Conditions.
